This section sets out the Terms and Conditions under which Chelsea Young Writers Ltd (“CYW”) agrees to provide services to you and your child (“You”).
Please note that we amend these Terms from time to time. Before making a booking, please check this page to ensure you understand the Terms which will apply at that time. These Terms were last updated on 26th June 2023.
1. General Policy & Procedures
1.1 CYW will provide instructors to deliver educational programmes, including after-school, in-school, and holiday programmes.
1.2 CYW reserve the right to replace instructors at any time.
1.3 Workshop dates will be announced via the CYW website, newsletter and any additional marketing channel.
1.4 All materials provided by CYW to you, remain the intellectual property of CYW.
1.5 It is Your responsibility to alert CYW of any medical complaint suffered by Your child.
1.6 CYW maintains a comprehensive Public Liability Insurance policy, a copy of which is held at CYW head office.
1.7 All teaching staff of CYW maintain up-to-date DBS check certificates.
1.8 CYW does not accept responsibility for the loss of, or damage to, personal belongings, including valuable items, brought onto the premises. CYW will not be responsible for any items left at the venue by the student or You and may dispose of any such items if not claimed and collected by you within seven days of the end of the workshop/course.
1.9 CYW cannot be held responsible for accidents or injuries that may occur as a result of children tripping, falling or bumping into other children during workshop hours.
1.10 CYW may limit access to their own or hired spaces to CYW students only, on the grounds of Health and Safety.
1.11 CYW cannot be held responsible for supervision of your child and do not accept liability for any loss, accident, or injury that may occur prior or after scheduled workshop times. This includes outside space at the premises if available.
1.12 This agreement is governed by English Law and any dispute will be dealt with under the exclusive jurisdiction of the courts of England and Wales.
2. Booking & Payment
2.1. Upon completion of your order online or otherwise on a signed registration form, a contract will exist between You and CYW.
2.2. Workshop fees must be received in full prior to the child’s attendance.
2.3. You may transfer your paid booking to another person with no additional charges to be paid. An application form will need to be completed by the new client before the commencement of the workshop/course or we may refuse the enrolment.
2.4. There is an administrative charge of £10 where a cheque is returned unpaid by your bank.
2.5. While we make every effort to ensure the smooth functioning of our booking system, we cannot guarantee its flawless performance in every situation or setup. If for any reason you are unable to submit your booking via our web booking system, regardless of payment method chosen, a £30 administrative fee will be added to your order.
3. Cancellation and Refund Policy
3.1. If You miss any workshop/course for one or more days, no refund is available. At the sole discretion of CYW, and provided you notify us with 48 hours notice prior start of the programme, You may be offered a make-up session if you miss one in term-time. Make-up sessions are not available for holiday or Saturday club.
3.2. In the event of cancellation by You. If You are unable to attend a workshop/course, You should inform us in writing as soon as possible, as cancellation charges apply dependent on notice given. A cancellation is only valid when it has been received and acknowledged in writing by CYW. Cancellations must be made in writing, by email, to [email protected]. We do not accept cancellation by telephone or any other methods.
3.2.1. If you choose to cancel your booking at least 14 calendar days before the start of the workshop/course, you will be eligible for a refund. Please note that a £30 administrative fee will be deducted from your refund. There is a limit of one refunded booking per year. CYW will not be liable for any charges incurred by you when sending a refund.
3.2.2. No refunds will be issued for bookings cancelled less than 14 calendar days prior to the date of the course/workshop. In light of the SARS-CoV-2 epidemic that has hit the UK in March 2020, when cancelling a booking that was placed on or after 20th March 2020, within the 14 days, you will be entitled to a credit note valid for the next 12 months.
3.3. In the event of cancellation by CYW. On occasion, unforeseen circumstances or where the number of bookings does not reach the minimum required to operate the programme, may require CYW to cancel a workshop/course. Under these circumstances, You will be given as much notice of the cancellation as possible in writing and either a transfer to another date or venue or a full refund of fees paid will be offered. Should a programme be cancelled for any reason, CYW will accept no responsibility or liability for any pre-paid travel or accomodation fees for attending students.
4. Change of Programme
4.1 We will make every effort to deliver the programme as advertised at the time of Your booking, but we reserve the right, without liability, to change the specifics of the programme where circumstances beyond our control necessitate such changes. Should circumstances beyond our control dictate changes, CYW reserve the right to make changes to all services provided including, but not limited to, the programme, teachers, locations, dates and will promptly notify you in writing.
5. Student Behaviour
5.1. Your child will be expected to behave appropriately, showing respect to property and fellow students. Disruptive behaviour, bullying, or aggressive attitude towards other students, parents and CYW staff will not be tolerated.
5.2. CYW reserves the right to refuse admission at any time or to remove any student whose attendance or behaviour is deemed unsatisfactory. Under such circumstances, CYW will be under no obligation to return any fees.
5.3. No food, sweets, nor drinks apart from still water will be permitted in the carpeted areas. No chewing gum is allowed in the premises.
6. Health and Medical
6.1 Before we can accept your child as a student, it is your obligation to give us information and instruction regarding their healthcare and medical needs. We accept students on the assumption that they are in good health, unless otherwise stated in the registration form. It is your responsibility and obligation to tell CYW prior to the start of the programme of any issue or condition that may affect your child, including but not limited to: ADHD, ASD, SEN, speech and language difficulties, disabilities, food allergies or other medical condition, behavioural or social issues.
6.2 If your child joins our programmes with a medical or behavioural condition that we did not know about, we reserve the right to remove your child from the programme, if it is determined that we do not have the resources to meet your child’s needs and safeguard them properly.
6.3 CYW will ensure there are First Aid trained staff on site at all times but your child may be charged for a consultation with a doctor. In case of medical emergency, your child will be taken to the nearest Accident & Emergency department.
7. Promotional material
Sometimes we take photographs and videos during our courses which we may use for promotional purposes. Please advise us if you do not wish your child to appear in any promotional material.
8. Force Majeure
CYW shall not be responsible for any delays in performing, or for any failure to perform, any of our obligations if the delay or failure was due to any cause beyond our reasonable control including, without limitation, war, strikes, governmental regulations or orders, national emergencies, terrorism, lock-outs, fire, flood, drought, epidemics and pandemics or other natural disasters.
9. Property Rights and Use of the Website
Unless otherwise stated, we own the intellectual property rights in the website and material on the website. All our intellectual property rights are reserved. You may view, download and print pages or other content from the website for your personal use. You must not reproduce, duplicate, copy, sell, resell, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent.
10. Changes To This Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
